2012 Local Government Elections – the wrap…
The VLGA followed the results and trends in our Tally Room over the weekend, and we had a wide audience for our blog posts.  We are delighted to announce that our President, Cr Samantha Dunn, and Vice President, Cr Heinz Kreutz have both been returned to their respective councils, Yarra Ranges and Boroondara.  Other VLGA Board members who have been re-elected are Luba Grigorovitch at Hobsons Bay and Collin Ross at Cardinia.  Cr Christine Richards did not stand for re-election at Frankston.  Sadly, John Doull lost his tilt at a new ward in the City of Greater Geelong.  Other significant results are that Lord Mayor of Melbourne, Robert Doyle has been returned, and for the first time, Geelong residents have had the chance to elect their own Mayor and the results should be known by tonight. Much has been made of the need to review the 2012 Victorian local government elections and anecdotes that this has been the ‘dirtiest’ campaign in many years.  The media emphasis and commentary on the 2012 local government elections left many wondering if voters would be disconnected and disenchanted.  In many campaigns that were seen as ‘dirty’ or difficult, voters have seen through negative messages that played the person and not the policies and in fact, our analysis of voter turnout suggests people have been well engaged.  It would be wonderful if we could all see these elections as a true celebration of democracy.  A record number of people – 2003 – stood as candidates for local government in Victoria.  At the VLGA, we are looking at another trend, namely the number of uncontested wards across the State.  This is perhaps a more telling sign of a lack of engagement with local government.  It is not a reflection on those who have been elected unopposed – in fact we hear from many unopposed councillors that they would prefer a contest and to feel they have won on merit.  We also believe there is a need for a wider community debate about postal versus attendance voting.  Most local governments moved to postal voting in Victoria at the time of amalgamations.  There has been speculation that postal voting may lead to more ‘dummy’ candidates.  In contrast, it can be a more efficient process for local governments, and enables a greater number of people to participate in voting.  We plan to do some comparative research on this issue.  We have also heard from a number of people that they have been frustrated with the number of authorities governing the election process, depending upon the issue.  Finally, we hope that many new and returning councillors will join us this Thursday evening for our special Leading Edge Forum with the Minister for Local Government, The Hon Jeanette Powell.  Further details can be found below.

VLGA’s Think women for local government campaign a success

While final local government elections figures are still being assessed, analysis by the VLGA reveals that the number of women elected to councils across Victoria has increased on the 2008 election.  There was a woman standing for election in every council in Victoria.  Overall, at this stage it looks like 34 per cent of successful candidates in this year’s elections are women, compared with the elections in 2008, when close to 30 per cent of candidates elected were women.  At least fifteen local governments have improved their overall gender balance – significantly in rural and regional Victoria at this stage.  These include Ballarat, Bendigo, Buloke, Gannawarra, Glenelg, Indigo, Murrindindi, Pyrenees, Queenscliffe and Southern Grampians.  In the metropolitan area, we note Boroondara, Cardinia, Frankston, Glen Eira, Hobsons Bay, Knox, Kingston, Manningham and Moonee Valley have increased their numbers of women councillors.  Hindmarsh stands out as having gone from zero to fifty percent women with even distribution across their wards.  Congratulations to Linda Bennett for her outstanding work in this project.  You can see our media release here.

Metropolitan Planning Strategy discussion paper launched

Planning Minster Matthew Guy launched the Melbourne, let’s talk about the future discussion paper at the Metropolitan Planning Strategy Symposium held on Friday.  Prepared by a Ministerial Advisory Committee, the paper is designed to prompt debate about the challenges Melbourne faces and ideas for the future.  The Discussion Paper sets out nine principles to inform the Metropolitan Planning Strategy.  Five of these principles identify the outcomes the Strategy needs to address and the remaining four principles outline how these outcomes can be achieved.  The VLGA will work with members and supporters in the coming months to develop a response to the discussion paper.  Please contact Toby Archer, our Director Policy, via email if you would like to contribute.

Draft Victorian Waste and Resource Recovery Policy released
Yesterday, Minister for the Environment and Climate Change, Ryan Smith released the Draft Victorian Waste and Resource Recovery Policy.  With Victoria’s current waste policy Towards Zero Waste ready to end in 2014, the Victorian Government has undertaken a review of the existing waste policy settings and practices.  Earlier this year, the Department of Sustainability and Environment (DSE), in conjunction with environment portfolio partners, ran extensive consultation with industry, government and community. The draft draws on insights, priorities and issues identified throughout this consultation.  From the website you can make a submission to the draft policy as well as find a link to the DSE Yammer online discussion group for the Waste Policy Review.  Responses are due by Friday 23 November 2012.

Local Government (Miscellaneous) Bill 2012
Last Thursday night the Victorian Parliament passed the Local Government (Miscellaneous) Amendment Bill, which includes 17 amendments covering decision-making and governance; councillor conduct; rates and municipal charges; and general administration.  In the VLGA’s view, the amendments are a mix of sensible improvements and unnecessary interventions.  We are disappointed that the Victorian Government is now able to prohibit differential rates which councils have developed in consultation with their communities but we will work with the Multi-party Ministerial Committee to develop the ministerial guidelines on differential rates.   Election donation returns will now be published on council websites.  This is an important step toward improving transparency in local government.

VLGA submission to the Vision for Citizenship in a Multicultural Victoria
Last week, the VLGA made a submission to the Victorian Government’s Vision for Citizenship in a Multicultural Victoria.   In our submission, the VLGA strongly supported the development of a comprehensive whole-of-government strategy to enhance voting accessibility, electoral knowledge and communication with individuals and communities of CALD backgrounds.

Tobacco Amendment (Smoking at Patrolled Beaches) Bill 2012
This Bill was moved for a second reading in the Legislative Council on 25 October.  While the VLGA welcomes the Victorian government taking action to prohibit smoking in public places, we believe the proposal to ban smoking at patrolled beaches is unnecessarily modest.  We strongly believe the Victorian government should adopt a comprehensive approach to prohibiting smoking in public places similar to the approach adopted by the Queensland government in 2005.  In order for bans on smoking in public places to be effective, they should be comprehensive and consistent across the State.  Reliance solely on the local government sector to reduce smoking in public places will result in a patchwork of local laws that will not benefit from the self-enforcement of a state-wide ban.  We are also concerned that enforcement responsibilities will fall to local governments.  We strongly recommend the provision of additional financial resources to those coastal local governments required to enforce the proposed ban.

Congratulations to Ballarat

The Ballarat City Council Community Charter for the Prevention of Violence against Women, designed to make it easy to endorse, has been launched and looks very impressive.  Congratulations to retiring councillor Cheryl Bromfield and the Ballarat team on this initiative.

On Thursday evening, the VLGA hosted an informal dinner in North Melbourne for member councillors, to thank them for their service to their local communities and to the wider sector.  A number of councillors who attended are not re-standing, and others are awaiting the results from their campaigning on or soon after 27 October.  It was a lovely evening and we are delighted to have hosted you and spent time with you.  Please again accept our sincere thanks for your service, your support to the VLGA and your friendship, and for those of you not standing again, we hope we can assist you to remain involved with local government through the VLGA.  Best wishes for the week ahead, and I trust we will see a number of you at our November Leading Edge Forum with Minister Powell, and our Essential Councillor Weekend.

An update on Constitutional recognition of local government
Last week, the President of the Australian Local Government Association (ALGA), Felicity-ann Lewis welcomed Federal Local Government Minister Simon Crean's intention to move a motion in Parliament later this month to establish a Joint Select Committee on constitutional recognition of local government.  The ALGA is seeking an amendment to Section 96 of the Australian Constitution so that it would read: 'Parliament may grant financial assistance to any state or local government body formed by or under a law of a state or territory on such terms and conditions as the Parliament sees fit'.  See more in the ALGA’s media release.  VLGA members might also like to read an article from the 19 October edition of The Conversation, Constitutional recognition for councils: a better governed Australia, by The Hon Dr Ken Coghill, Associate Professor at Monash University.

Congratulations Northern Grampians
Northern Grampians Shire Council last week received the DSE’s Water Efficiency Improvements Award at the Regional Achievement & Community Awards 2012.  Well done!



Vale Cr Ray Hewitt 
The VLGA has been advised that Cr Ray Hewitt, former Mayor, and current councillor at Northern Grampians Shire passed away suddenly on Saturday morning after a short illness.  Ray was seen by many as a fierce advocate for local government and as having made an exemplary contribution to the Shire.  Ray served as Mayor of the Shire in 2010-11, and had just completed his second term as a councillor.  He had announced in the lead up to the 2012 election that he would not be standing again.  The VLGA’s thoughts are with Ray’s family, current Mayor Cr Dorothy Patton, councillors and staff at this time.

Draft report released – Inquiry into Social and Economic Costs of Problem Gambling in Victoria
The draft report Counting the Cost: Inquiry into the Costs of Problem Gambling was released on Friday by the VCEC for its inquiry into the social and economic costs of problem gambling in Victoria.  The VCEC has estimated that problem gambling has cost the Victorian economy up to $2.7 billion a year, and says most of the cost is being borne by problem gamblers and their families.  The VCEC seeks stakeholder views on its approach and suggestions for a future research agenda related to the costs of problem gambling.  Submissions on the draft report can be made to the Commission via email by 16 November 2012.

Public Libraries Ministerial Advisory Council
The Ministerial Advisory Council on Public Libraries (MAC) held its most recent meeting on 15 October.  Stage One of the review of Victorian public libraries being conducted by the MAC is due to be completed by the end of the year, and a Stage One report is due to be released in late November 2012.  A comprehensive consultation and submission process was undertaken, commencing in February when the Tomorrow’s Library discussion paper was released.  Over 1500 formal submissions and community contributions responding to the discussion paper were received.  The MAC met with more than 55 councils and all 12 regional library corporations during the consultation process, and 12 roadshow events were also held around Victoria, attended by more than 400 community members.

I was privileged to attend two motivating events last week.  Congratulations to the Australian Local Government Women’s Association (ALGWA) Victoria on their successful luncheon at Parliament House last Thursday, celebrating the achievements of women in local government.  Ministers Jeanette Powell and Mary Wooldridge both addressed the luncheon as did Shadow Minister for Women Danielle Green and Member for Western Metropolitan region Colleen Hartland.  You can read Minister Powell’s media release about the event here.  On Friday I was delighted to be a guest of Reconciliation Victoria at The Long Walk Women’s Luncheon.  This is always an inspirational luncheon and Friday’s was no exception, with a speech from special guest Jessie Mabo, daughter of the late Eddie Mabo, who achieved such enormous change for our nation, after he and several other Meriam people of the Murray Islands in the Torres Strait began action in the High Court of Australia seeking confirmation of their traditional land rights in May 1982.  Ballot packs have reached letterboxes for the majority of Victorian ratepayers for postal elections – so candidates you can now take some ‘time out’ to have a look at the dedicated on-line version of the Good Governance Guide which was launched last Monday.  The site has already received a huge amount of traffic and we are confident that it will be well-used by councillors and officers across Victoria.  You can also view the VLGA’s election e-bulletins here.

Local government legislation miscellaneous amendments
The Victorian Parliament is still considering the Local Government Legislation Amendment (Miscellaneous) Bill 2012.  Amongst a range of controversial changes, the Bill requires a CEO to notify the Mayor and Council when they become aware of a complaint about their conduct.  Last week the Legislative Council passed the Bill with an amendment to exclude frivolous or vexatious complaints against a CEO from this requirement.  The Legislative Assembly will consider the amended Bill during the next sitting week later in October.

Smoking banned at patrolled beaches
The Victorian government has introduced legislation to ban smoking between the flags at patrolled beaches.  Smoking will be prohibited between the flags at patrolled beaches and within a 50-metre radius of the flags.  Once implemented, the ban will limit exposure to second hand smoke, reduce litter of cigarette butts and denormalise smoking.  Whilst we would have preferred the legislation to go much further, the VLGA anticipates this is an important first step toward a uniform approach to smoking in public places.

Candidate Survey
The VLGA is conducting a survey of candidates in the 2012 Local Government Elections.  We are keen to know more about who is running for local government and what issues are the focus of their campaigns so far.  The short survey should take less than 10 minutes to complete and is open until Wednesday 17 October.

VLGA Director Governance at ACELG research forum
On Thursday, VLGA Director Governance Ron Exiner attended an Australian Centre for Excellence in Local Government (ACELG) research forum in Brisbane.  Ron chaired the Political Governance session which featured recent papers from Graham Sansom on the role of the mayor and John Martin on mayor/CEO relationships as well as the current project on political governance and leadership in which the VLGA is partnering with ACELG.  There was some very interesting discussion following the presentations which included the impact of directly elected mayors and whether gender issues play a role in the quality of working relationships.  The VLGA believes that ACELG is doing very important work in the area of local government reform and we intend our partnership with them will lead to new ideas and further conversations in the sector about the future of local government.

A Parliamentary Committee on constitutional recognition?
Late last week we also received news that Federal Minister for Local Government, Simon Crean has advised the Australian Local Government Association (ALGA) that the Government is negotiating a motion to be introduced to the Parliament for the establishment of a Parliamentary Committee to consider the timing of a referendum on constitutional recognition of local government.  More information can be seen here.

Action plan to address violence against women
The Victorian Government announced its Action plan to address violence against women last week.  The action plan covers prevention, early intervention and response measures and includes new and expanded initiatives worth $7.9 million.

The John Jago Good Governance Award is awarded annually to a VLGA member local government or community group (or groupings) whose governance and leadership practices have led to improved public participation in decision-making.  Applications for the 2012 Award are now invited.  There is a two-stage process and first-stage applications should be submitted to the VLGA by Friday 19 October.  Applications can be emailed or sent as hard copy.  Further information can be found on our website or by contacting Ron Exiner, Director Governance, on 9349 7999 or via email.

VLGA End of term councillor survey – results are in
The VLGA End of term survey has now closed and we thank the large number of councillors who responded.  The report will be available for you soon.  In the meantime, here are some highlights from the things you told us.  Councillors from 51 local governments responded – 38.5% were first term councillors, and 30% were in their second term.  The picture you gave us of family and carer responsibilities was interesting.  Of those respondents with partners, around 60% of partners work full or part time.  If we keep in mind that around two-thirds of councillors work full- or part-time also, and a lot of council work is undertaken in the evenings or on weekends, we can see the ‘juggling’ pressures that exist for families.  A small number of councillors told us they resigned from paid work because they could not meet the demands of both work and council.  Of course, as we anticipated, remuneration levels also figured highly in your concerns.  Those of you at the time of the survey who couldn’t decide whether or not you wanted to run for local government again were influenced by low pay more than any other factor.  However, we asked some different questions this year which revealed some new themes – 41.5% of you told us that being a councillor has had a positive impact on your careers.  Previous surveys have focused on the ‘costs’ of being a councillor – often the financial costs of missed promotions, time off work, etc.  When given the opportunity to think more broadly about this, many of you identified positive career outcomes such as the development of new skill sets and new areas of knowledge.  You also told us that you were generally very happy with the support from council administrations – 73% of you said it was ‘very good’ or ‘good’.  Also on a positive note, many of you had decided to stand again, and your main reason was to see through projects you had started and changes you had been closely associated with.  More news on the survey next week!  It’s Mental Health Week in Victoria and World Mental Health Day is this Thursday.  Click the links to find out more about these important initiatives.

Representative local democracy: an analysis of experience in Australia

What is the right number of elected members to properly represent and manage a community's interests?  How should wards and boundaries be determined?  These are the kind of questions that a new research project on 'Representative local democracy: an analysis of experience in Australia' is investigating.  The VLGA is partnering with the Australian Centre of Excellence for Local Government (ACELG) to analyse the approaches taken across the country to address the question of representation. 

Local Authorities Superannuation Fund
As reported in recent eNews bulletins, the VLGA has sought the Prime Minister’s support to remove the 15% contributions tax that local governments will be required to pay on the shortfall; and for legislation that will return the scheme to an exempt public sector fund, thereby removing the requirement to ensure full funding.  We recently wrote to all other Victorian Members of the House of Representatives encouraging them to meet with the local governments in their electorates to understand the impacts on the infrastructure and services provided to their local communities, and to support our call for new legislation.  A number of MPs have either called us or responded in writing and will be seeking meetings with their relevant local governments.  Several have also raised the matter with the Prime Minister and Minister Crean.

Don’t forget – John Jago Good Governance Award 2012 first-stage applications close Friday 19 October
The John Jago Good Governance Award is awarded annually to a VLGA member local government or community group (or groupings) whose governance and leadership practices have led to improved public participation in decision-making.  Applications for the 2012 Award are now invited.  There is a two-stage process and first-stage applications should be submitted to the VLGA by Friday 19 October.  Applications can be emailed or sent as hard copy.  Further information can be found on our website or by contacting Ron Exiner, Director Governance, on 9349 7999 or via email.

Premier’s Sustainability Awards 2012 – congratulations!
Congratulations to the 2012 winners of the Premier’s Sustainability Awards, in particular Local Government Award winners, Brimbank City Council; State Government Award winners, which included Alpine Shire Council as a partner; and Community Award winners, Kildonan Uniting Care and Moreland Energy Foundation. 

Melton becomes a City
Congratulations to Melton City Council!  Melton has been declared a City by the Minister for Local Government, Jeanette Powell.

National Butt FREE Day a First!
On Thursday 18 October, Australia is hoping for a “Butt Free kind of Day”.  It’s the first National Butt Free Day – when all of us can highlight the environmental threat posed by the seven billion butts being littered every year around Australia.  Butt Free Day is being implemented in all states using the resources of the Butt Free website.  Butt Free Australia needs individuals, businesses and organisations to register as supporters of Butt Free Day 2012 to generate greater community awareness of the problem.  To register, email or telephone (08) 8234 7255.

Women’s participation in local government is strong
In the lead up to the 2012 local government elections, most of you will be aware that the VLGA has been running the Think women for local government 2012 Project to attract more women to local government.  The project has received financial support from the Victorian Government and has been strongly supported by Minister for Women’s Affairs, Mary Wooldridge, and Minister for Local Government, Jeanette Powell, a former local government councillor and mayor.  The Project has provided women interested in standing in the October elections with specially designed information packages, mentoring and support opportunities as well as knowledge and skills development.  Nominations for local government elections closed last Tuesday, and our analysis shows that women’s participation in local government elections has increased on the 2008 election.  There is a woman standing for election in every local government in Victoria.  Overall, 33 per cent of candidates in this year’s elections are women.  This is an increase on the last local government elections in 2008, when 31 per cent of candidates were women.  Women candidates number 664 out of a total 2004 candidates vying for 631 positions.  In 2008, there were 614 women candidates.  There has also been an increase in the number of wards with women candidates.  In 2012, almost 80 per cent of wards have at least one woman candidate, up from 75 per cent at the last election.  The introduction of four year terms, changes to electoral systems and the absence of a concerted effort to support women in previous elections have been key factors influencing women’s participation.  There are some notable improvements in participation in rural Victoria.  Hindmarsh and Pyrenees had no women candidates in 2008 – this election there will be four women standing for election in both councils.  The increase in the number of women nominating for election is a significant achievement for those individuals and the families and communities who support them.  We now have clear evidence that ensuring women have greater resources and information about local government means they will nominate for council.  If we want to increase women’s participation in local government, we need long term investment in developing women’s capacity as community leaders and election candidates.  There’s plenty more to be done to encourage even more women to nominate next time.  The story doesn’t end here.  Good luck everyone!

Differential rates parliamentary committee
Recently in eNews the VLGA reported that the Victorian Parliament has not yet passed the Local Government (Miscellaneous) Bill 2012, with debate continuing in the Legislative Council from next week.  The VLGA understands that the State Government has launched a parliamentary committee to investigate the use of differential rates by local governments and we will report more to members about the committee and its terms of reference.

Reformed planning zones for Victoria
In our submission to the planning zones reform consultation process the VLGA made two key recommendations: that the Department extend the implementation period for the reformed planning zones for an additional 12-month period; and that the Department make additional financial resources available to local governments to facilitate the timely implementation of the reformed zones.  The local government sector plays a central role in the administration of the planning system.  Local governments are also crucial to ensuring that planning is relevant and responsive to local circumstances and needs.  Unfortunately, in our view, the process to develop a new system of planning zones has not been a true partnership between the levels of government.  The consistent feedback in our consultation with our member local governments has been the concern about the inadequate consultation in the development of the reformed planning zones.  The timing of the consultation is of particular concern given the consultation period is occurring as the local government sector is entering the caretaker period leading up to the elections in October 2012.  While many local governments have sought the views of their local communities in the formation of their responses to the changes, the Department does not appear to have undertaken significant consultation with local communities.  This process has served to undermine community confidence in the planning system. National Food Plan green paper
The VLGA has submitted our response to the Commonwealth Government's National Food Plan (NFP) Green Paper.  Our submission makes several recommendations based on feedback from members and our previous food security work.  In summary, we have recommended:
* further risk assessment be undertaken regarding natural resource depletion and our changing climate and the possible impact on our food supply;
* better support for farmers who practice sustainable food production especially within local food systems and short supply chains;
* that the Commonwealth Government draws on relevant data and food modelling including the extensive work undertaken by the VLGA and our partners;
* that the NFP makes the reduction of food waste across the food chain (including in landfills) a central objective.

VLGA teams up with OurSay for discussion about Geelong mayoralty
At 9am on 26 September, the OurSay Geelong mayoral project went live.  For the first time ever, the people of Greater Geelong will have the chance to directly elect their Mayor.  This much talked about move has let the public into a process where the mayor was previously chosen behind closed doors.  Now that the people are in the driver's seat, we want to know what issues you think the new mayor should tackle?  What do you want to see changed in Geelong?  OurSay is teaming up with the MAV and the VLGA to promote genuine community debate in the lead up to these elections.

VLGA submission to the vision for Citizenship in a Multicultural Victoria

The Victorian Multicultural Commission is seeking feedback to its Vision for Citizenship in a Multicultural Victoria vision statement.  The purpose of this statement is to summarise the Victorian Government’s outlook for the future of cultural diversity in Victoria.  The VLGA will be providing a brief submission and invites members to provide their feedback by COB on 24 October 2012.  For further information, contact Jieh-Yung Lo on (03) 9349 7980 or via email.

Bikes an issue in council elections?
A recent media release from Bicycle Network Victoria (BNV) states that “Victoria’s booming population of bike riders could play a decisive role in this year’s council elections.”  BNV says more than 1.1 million Victorians ride a bike each week and they have launched Votebike – an online system that allows a candidate in the forthcoming local government elections to present their credentials directly to riders.  Votebike enables candidates to fill in a web form that places their information in front of riders residing in that electoral area.  Riders can then review candidates’ statements and contact candidates if they wish.

Forest Audit Program 2012 Community Open Days
The Department of Sustainability and Environment (DSE) is holding two community open days for the public to learn about the Forest Audit Program and attend an active audit of a commercial timber harvesting coupe.  The first open day will be held in the East Gippsland Forest Management Area (FMA) on Wednesday 17 October and the other will be in the Central FMA on Wednesday 14 November.  Those who wish to participate in the community open days must register with DSE by 10 October for the East Gippsland FMA and 7 November for the Central FMA.  For further information or to register your interest in attending a community open day, please email.  Participants will be required to provide their own 2WD transport to the coupes however car-pooling may be possible.
